Contempt of Court: MV Jayarajan justifies his remarks

September 06, 2011: Justifying his remarks against High Court judges earlier, CPM leader M.V. Jayarajan opined that he had not criticized the judges but instead had criticized the Court order imposing a ban on roadside meetings by political parties.

The High Court was hearing on the contempt of Court case against MV Jayarajan for his unparliamentary remarks against the judges at a public meeting in Kannur on July 1, 2010.
In the draft memo of contempt of Court charges, Registrar-General of the High Court had charged Jayarajan with making ‘‘denigrating, humiliating, and discreditable comments” which tend to “scandalise and lower the authority and dignity of the High Court judges.”
His statement tended to interfere with and obstruct the administration of justice. He was, therefore, liable to be proceeded against under Section 2(c) (criminal contempt) and Section 12 and 15 of the Contempt of Court Act, the memo of charges had said.
