HC cancels election of Varkala Kahar

Tuesday, August 22, 2012: The Kerala High Court Tuesday declared the election of Congress MLA Varkala Kahar as null and void.

The court nullified the election on the basis of petition by Prahladan, a candidate from Kollam whose nomination was rejected.

In the election affidavit submitted by Prahaladan, a technical failure of a missing stamp led to his chance of not contesting the election and he approached the court saying this is illegal.

The HC flayed the decision and stated that just for the sake of a stamp, a candidate should not be dismissed. Through this, the chance of a candidate to contest the election has been lost, ruled justice Satish Chandran and dismissed the election.
