KOCHI: The Kerala High Court rejected state government’s plea requesting to permit them to take over the land of Harrisons Malayalam Ltd (HML). The division bench passed the new order after nullifying the former one on it.
The government requested to permit them to take over almost 60,000 acres of land which are in the hands of Harrisons. The government approached the court pointing that a foreign company has no right to hold the land. The court completely rejected government’s argument.
The court said the ownership rights are a constitutional issue and it should be examined in detail and asked the government to seek steps for it.
The court said the government can take legal steps if Harrisons have violated FEMA. If cases are registered in the taluk and land boards, the government can continue that.
The high court granted permission to the company to fell trees from the eight estates of Harrisons. The court also directed the government to return the bank guarantee of Rs 18 crores received from the company for felling trees.
