Filing of chargesheet against marines delayed


KOLLAM: The chargesheet in the killing of fishermen case may not be filed within 90 days of the arrest of two accused Italian marines Latorre Massimiliano and Salvatore Girone, opening up an option of default bail for the two accused marines.  Investigation team sources said they are prepared to file the chargesheet, but will not file it until the Supreme Court passes a judgment on the plea by the Italian Government seeking to quash the FIR in the case.
The investigation team will inform this matter to the CJM court. The Marines were sent to remand by the First Class Judicial Magistrate Court Judge, Karunagappally, on February 20 and the 90-day period will come to an end on May 19. However, defence counsel sources indicated that they are less likely to opt the default bail, almost for the same reason.   ‘’Right now we are looking at the outcome of the petition to quash the FIR. The question of applying for bail comes only later,’’ sources said.  
Incidentally, the Italian side, was reluctant to move a bail petition during remand period.  They think that bail petition would mean that abiding to the law of the country and would affect FIR quashing case.
