Saturday, August 13, 2011: The Nation Aviation Company (Air India) filed an appeal in the Kerala High Court against a recent verdict that held that the company was bound to pay a minimum compensation of Rs 75 lakh to the legal heirs of the victims of the Mangalore air crash.
The single judge had made the observation while directing that company to pay the balance compensation amount within one month to the family members of B Mohammed Rafi, who died in the crash.
In its appeal the company said the single judge order holding that it was bound to pay one lakh Special Drawing Right (SDR) to the families of the victims was wrong. The appellant argued that the conclusion reached by the court, which cited the provisions of the Montreal Convention, was not fair.
The court, while allowing a petition by the family member of Mohammed Rafi, said it was clear that the intention of law maker was to bring about parity in the matter of payment of compensation of the passengers, irrespective of class of travel.
