KOCHI: A petition has been filed before the High Court of Kerala on Wednesday challenging the provisions under the Right of Children to Free and Compulsory Education Act 2009.
The petitioners, V M Muralidharan, manager, AUP School, Vellamunda, Malappuram, and 10 others alleged that the provision that enables local bodies to interfere in the management and administration of schools was a violation of various provisions of the Constitution.
The Central Act enables the state governments to frame their own rules for implementing the Act. As per this, the Kerala Government on May 2011 issued the rules including various clauses.
The state government has conferred on the local self-government authorities rights regarding the management and administration of the elementary schools. The Act further enables the local authorities to nominate a member to the managing committee of the schools.
