State government control on CBSE schools: HC seeks Centre’s report

The Kerala High Court on Thursday asked the Central government to file a statement if the state government can exercise its power on CBSE schools.

The Bench comprising Justice C N Ramachandran Nair and Justice C K Abdul Rahim issued the directive on an appeal filed by the state government against a single judge’s order staying the government stipulation that the CBSE schools seeking no objection certificate should have minimum of three acres of land and that the schools should have been functioning for five years with a minimum of 300 students. The court also impleaded the Centre in the case. The Single Judge issued the interim order on a batch of petitions filed by various CBSE school managements.

The judge directed the state government to consider the applications submitted by school managements without insisting on the two stipulations and pass appropriate orders.

When the appeal came up for hearing, state contended that the CBSE schools are autonomous institutions. Therefore, the State has control over them.
