Wednesday, June 15, 2011: The Kerala High Court on Wednesday came down heavily against Justice PA Muhammad committee in the case relating to self-financing medical fees.
A division bench comprising Justice J Chelameswar and Justice Antony Dominic pointed out that the committee should be able to implement its own order and there is no need to approach the Court.
Justice PA Mohammed Committee was acting more loyal than the king by approaching the court against the stay, the court observed. The only persons affected by the stay order were the SFCs and the state government which appointed the commitee, the division bench said.
As a committee formed by the government based on the self financing law, the government should have approached the court, the bench said. It is an unprecedented happening that a committee with judicial powers filing an appeal, the court said.
