NEW DELHI: In a strong set back to Kerala in the Mullaperiyar dam case, the Supreme Court ordered to raise the water level to 142 feet.
A constitutional bench comprising of Chief Justice R M Lodha, Justices H L Dathu, C K Prasad, Madan P Lokoor and M Y Iqbal pointed out that the court had rejected the demand of Kerala for a new dam in Mullaperiyar and the dam safety act passed by Kerala to pass over Supreme Court’s former order in 2006 allowing to raise the water level is unconstitutional.
A panel led by the chairman of central water commission and a representative each from Kerala and Tamil Nadu has been entrusted to look into the matters of raising the water level and the safety of the dam. The court asked Tamil Nadu to bear the full expenses of the panel’s functioning.
The court harshly criticized Kerala for passing the dam safety act against Supreme Court order permitting to raise the water level in Mullaperiyar to 142 feet in 2006. The division bench also pointed out that a legal fight in a case where a final verdict had been pronounced is like challenging the dignity of the court.
