'CBI findings not based on scientific evidence'

THIRUVANANTHAPURAM: The CBI Court, here on Saturday, observed that the findings in the furnther investigation report of the CBI in the Kaviyoor case, that Anagha was sexually abused by her father, were not based on any scientific evidence.
Special Judge T S P Moosath made this reference while hearing the argument in the petition filed by T P Nandakumar seeking the cancellation of the further investigation report and ordering another investigation by an expert team and monitored by both CBI court and High Court.
The petitioner, who appeared for himself, argued that the girl had attended her classes till a day before her death, contrary to the finding in the report by the investigating agency. The CBI had pointed out that Anagha and family had not moved out of the house two days prior to their death, based on ‘circumstantial evidence’ in the further investigation report.
Anagha, 15, her father Narayanan Nampoothiri, 40, mother Sreedevi, 35, sister Akhila, 8, and brother Akshay, 6, were found dead in their rented house at Kaviyoor near Thiruvalla on September 28, 2004.
The CBI had submitted a further investigation report in the CBI court on December 16, 2011, stating that Narayanan Nampoothiri had sexually abused his daughter two days before their death.
The report, filed by CBI S P Nandakumar Nair, had pointed fingers at the father without conducting the DNA test of the samples and based on the statements of a friend of the victim as well as circumstantial evidence.
The petitioner had submitted a list of 30 persons, including, prominent CPM leaders and their sons warranting an investigation on their suspected involvement in the case.The argument will continue on March 23.
