Election of E Ahamed as MP challenged

Sunday, March 25, 2012: The Delhi High Court has admitted a petition challenging election of Union Minister E Ahamed from Malappuram Lok Sabha constituency in Kerala in view of merger of his party Muslim League of Kerala State Committee (MLKSC) with the Indian Union Muslim League (IUML).
Filing the petition through counsel Bahar-U-Barqi, IUML General Secretary A S Fathima Muzaffer sought direction from the court to the Lok Sabha Speaker to disqualify Ahamed from membership of the House and declare his election as null and void.
The petitioner said MLKSC is a state registered political party and due to “misrepresentation” by the Minister of State for External Affairs, the Election Commission has confirmed amalgamation of MLKSC with IUML on March 3 and recognised Ahamed as IUML President.
Claiming to have obtained the informations through RTI application, the petitioner prayed that EC’s communication confirming amalgamation of MLKSC with IUML be stayed and Ahamed restrained from claiming himself to be IUML chief as also MP.
“Ahmed misrepresented EC, Law Ministry, Lok Sabha and even UPA Chairperson and the Prime Minister that he belonged IUML and became part and parcel of UPA government,” the petitioner said.
Alleging that EC paid no attention to IUML’s objections against the minister’s claim to be IUML chief, the petitioner said the EC has a turned blind eye to its representations and confirmed “illegal” amalgamation of MLKSC with IUML.
Admitting the plea, Justice Vipin Sanghi sought response from Ahamed, the EC, Law Ministry and the Lok Sabha Speaker by July 12.
