Govt appeal goes in vain; helmet must for pillion riders too

KOCHI: The government that had gone for appeal against a high court stay on government order exempting pillion riders on scooters from wearing helmet got an unfavourable reply from the court on Friday. The court clarified that stay would not be granted to its earlier order but the high court accepted the appeal in the file.

The government said in the court the new order was not practical for women riding pillion on scooters. The 2003 Motor Vehicle Act was hence amended considering this fact.

The government released a notification on Oct 13, 2013 granting exemption to pillion riders from wearing helmet. The new instruction was given after amending Motor Vehicles Act 347 (A). It was Fort Kochi native T U Raveendran who later approached the court questioning the amendment. Following this, the govt order was stayed.
