Munnar: HC orders compensation for demolished resorts

KOCHI: Kerala High Court Division bench has ordered compensation for resorts in Munnar that were demolished by the eviction team formed by the former LDF government as part of the operation to reclaim illegally occupied lands.

The division bench comprising Chief Justice Ashok Bhushan and Justice A M Shafeeq said that the eviction team’s actions were illegal. At the same time, in order to reclaim the usurped land, the team can go about with measures permitted by the law.   

Earlier, in a petition filed by Munnar Woods at Pallivasal Village, Cloud 9 at Chinnakkanal and Abad Resorts at Anaviratti Village , questioning the demolition drive, Chief Justice Manjula Cheloor   had issued an order favourable to them.

It was against the above petition that the government had filed review petition in the Division bench. The review petition filed by Opposition leader V S Achuthanandan along with the government’s petition was also dismissed by the court. The court also ordered the government to return the land acquired in Munnar. Munnar Woods should be paid a compensation of Rs 15000 and Cloud 9, Rs 10 lakh.  

The evacuation drive was carried out during the period of V S-led LDF government. The eviction team was headed by K Suresh Kumar, Raju Narayana Swami and Rishiraj Singh.

Then Munnar Woods’ 2.84 acre resort was demolished following the instruction of the district collector. Cloud 9’s three and a half acre land and building at Chinnakanal were also demolished.
