NEW DELHI: The Supreme Court refused to impose a stay on the Vizhinjam Container harbor project. The plea submitted by Anto Eliyas, a native of Valiyathura in the capital city and a leader of the Independent Fish workers Federation, had asked to stop the project.
A division bench led by Justices J S Kehar and Nariman said a decision has not been taken on whether it was right or wrong giving environment clearance for the project. The court pointed that assessments are still needed in this regard.
Meantime, the court asked if it is proved that giving permission for the project was wrong, then what alternate solution is there. The court, who pointed that developmental projects are needed, stated that protection of environment cannot be rejected. However, the harbor company informed the court that as permission has been granted for the project, sub-contracts have been given for the construction work.
The company argued that if the project is stopped, a loss of crore would be suffered. However, the court pointed that these are only technical reasons. If granting permission was wrong then can one change the environment to its old style? The company said yes. The argument in the case will be heard again on January 6. The Supreme Court had earlier sent notices to the central and state governments in the case.
